Who needs risk assessments for Legionella?
Approved Code of Practice regulations stipulate that landlords, employers of more than five people and anyone in charge of premises, are required to carry out a risk assessment for Legionnaires disease for each of their water systems. The failure to assess and then control the risk can result in enforcement action and fines, as well as prosecution and even imprisonment – this can occur even if nobody is actually exposed to infected bacteria.
The primary objective of risk assessment legislation is to identify all water systems that could present a potential breeding ground for the Legionella bacteria, and to assess the consequent risk of human exposure to any aerosols arising from those systems. All existing water systems must be included in every Legionella assessment, although special attention should be paid to:

Who can carry out Legionella Risk Assessments?
The ACOP regulations stipulate that if you are an employer of more than five people, or you are in charge of premises or water systems connected to your work, then you are required to carry out a risk assessment for Legionnaires disease for each and every one of your water systems. It is further required that that assessment must be executed by competent personnel who are fully trained to provide exactly that service.

How often do I need to do a Risk Assessment?
